Terms & Conditions

ARRIVAL AND DEPARTURE TIMES:
Unless prior arrangements have been made, Check in time is 4 pm or after and check out time is at 10 am or before. NO late check-out unless prior arrangements are agreed upon in writing.

RENTAL PARTY:
The maximum number of overnight guests is 22. No other outside guest may stay due to county fire regulations.

ESTATE RULES:
Minimum age requirement is 28
The Estate is NON SMOKING;
Pets are not permitted in the main house under any conditions;
Please do not move furniture, TVs or artwork from their locations;
No events or parties with outside invitees are permitted without written permission;
Insurance policy indicates caretaker is the only person permitted to light fireplaces;
Please park vehicles in parking lot only. Do not block the main road as it is a public/county road with through traffic. Be aware of other vehicles when crossing. Do not take vehicles off main road.
Please DO NOT enter rooms marked ‘Private’ or facility closets off pool area;
The pool area includes pool towels. Please do not bring bath towels into the pool area.
Please wipe feet before entering the Estate and/or the pool; otherwise you may incur additional maid service expenses

DAMAGE SECURITY DEPOSIT:
A damage security deposit is required. The deposit is NOT applied toward rent; however, it is fully refundable within ten (14) days of departure, provided all the following provisions are met.
• No damage is done to Estate or its contents, beyond normal wear and tear.
• No mess is left. The Estate is left in the same condition in which it was found. Additional clean-up services, above usual and customary, are charged at a rate of $100 per hour.
• All estate rules have been adhered to.
• No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
• All debris, rubbish and discards are placed in outdoor receptacles, and soiled dishes are placed in the dishwasher, which is run, and cleaned.
• All keys are left on the front kitchen island and Estate is left locked and all A/Cs and lights turned off.
• All charges accrued during the stay are paid prior to departure.
• No linens are lost or damaged.
• NO late check-out.
• The renter is not evicted by Landlord (or representative of the Landlord), or the local law enforcement.

POOL, STEAM ROOM, POND AND WATERCRAFT USE AGREEMENT FOR GUESTS OF ESTATE AT FLY CREEK
The undersigned hereby acknowledges that he/she has been advised that there is no lifeguard on duty at the Pool, Steam Room or the Pond and the undersigned and his/her family and guests will use the swimming Pool, Steam Room, Pond, and Watercrafts, including but not limited to kayaks and paddle boards, at their own risk. The Pool, Steam Room and Pond are intended for use by guests staying at the Estate. Team parties are prohibited at the property, including the pool and pond.

1. The posted pool rules must be followed at all times
2. It is EXPRESSLY FORBIDDEN to bring any type of glass container into the Pool area, and Steam Room. Evidence of glass breakage in the Pool Area will result in the pool being completely emptied, cleaned and filled at guest expense.
3. Minors in or around the swimming Pool, Sauna and Pond areas must be supervised by a responsible adult at all times
4. Anyone under the influence of drugs or alcohol is strictly prohibited from using the Pool, Sauna, Pond and Watercrafts at all times.
5. For emergencies call 911
6. Guests with physical limitations that impair their ability to swim should not use the Pool or Pond for purposes of swimming.

The undersigned further acknowledges that his/her right to use the Pool, Steam Romm, Pond and Watercrafts may be suspended in the event of any violation by the undersigned and his/her family or guests of the rules or in the event of any unsafe conduct by such persons in connection with the use of the Pool, Steam Room, Pond or Watercrafts.

The undersigned shall be responsible for any damage to equipment or property. If, after any activity additional maintenance beyond what is normal is required, the undersigned may be charged.

I certify that I have read and will abide by the rules and regulations pertaining to the use of the Estate at Fly Creek swimming Pool, Steam Room, Pond and Watercrafts.

RELEASE AND INDEMNITY AGREEMENT
The undersigned hereby releases, indemnifies and holds harmless Equestrian Center of Fly Creek, LLC and its owners, officers, agents, employees, and contractors from and against any and all incidents which may occur or result from said users use of the swimming Pool, Steam Room, Pond, and Watercrafts which includes any injury or death to person or property of any family member, guests, licensees, invitees, or any person permitted by said user within the Pool, Steam Room and Pond area during the agreed upon rental period. The undersigned releases the Equestrian Center of Fly Creek, Inc. and its Agents from any and all claims, damages, liability, and causes of action, including costs and attorney’s fees, arising from or related in any way to the use, by the undersigned or by his family, guests, licensees, or invitees, of the swimming Pool, Steam Room, Pond and Watercrafts at the Estate at Fly Creek property.

The undersigned agrees that this release and indemnity agreement has been read and is understood. The undersigned agrees and understands that this release and indemnity agreement is a necessary condition to obtain permission for the use of the swimming Pool, Steam Room, Pond and Watercrafts on the property.

Each adult staying on the property must sign and return prior to or upon arrival at the estate.

Payment Policy

* $2500 due when reservation is booked or reserved, including room charges, taxes, cleaning fee, and deposit and taxes.
* 50% of balance due 60 days prior to reservation
* Balance due 30 days prior to reservation

If you book your reservation less than 65 days out, you will need to pay first and second payments when you book; if less than 35 days out, you will need to pay your entire rental fee when you book.

We will give you a payment schedule when you book and will charge your card on those days.

Cancellation Policy

* 100% refund if you cancel at least 60 days before check-in.
* 50% refund if you cancel at least 30 days before check-in.
* No refund if you cancel less than 30 days before check-in.
