Terms & Conditions

In consideration of the monies received and the mutual obligation herein, the Owner/Agent does hereby lease, on a short stay basis that certain property described above, under the following terms and conditions. St. Maries Property Management, LLC (Agent) is a rental agent for the Owner and lets this property on behalf of Owner WITHOUT RESPECT TO RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN, HANDICAP, FAMILIAL STATUS OR SEXUAL ORIENTATION OF ANY GUEST.
,All bookings finalized through this platform will constitute FULL AGREEMENT to the Terms and Conditions herein. ALL BOOKINGS MUST BE MADE 24 HOURS IN ADVANCE OF EXPECTED CHECK-IN DATE AND TIME. ANY BOOKINGS MADE LESS THAN 24 HOURS IN ADVANCE WILL NOT BE HONORED, NO ROOM WILL BE PROVIDED AND GUEST AGREES TO FOREFEIT ANY MONIES PRE-PAID FOR SUCH AN OCCURANCE.
1. REPRESENTATION: Guest understands that Agent is employed by Owner to manage this property on behalf of Owner. Agent does not represent Guest.
2. NON-AVAILABILITY OF PROPERTY: In the event that the Owner is unable to deliver the property Guest at check-in due to fire, eminent domain, bankruptcy, receivership, foreclosure, act of nature, double booking, delay in construction or any other reason whatsoever, Guest's sole remedy and maximum damages recoverable as a result of any of these conditions is the full refund of funds previously received from Guest. If such an event occurs after check-in, Guest(s) recovery is limited to a pro-rated refund. Guest expressly acknowledges that in no event shall Agent or Owner be responsible for any expenses incurred as a result of Guest moving.
3. OTHER REFUNDS: There will be no refunds unless, at the time the Guest is to begin stay, the property is unfit and uninhabitable, and no EQUAL substitute can be found. The malfunction of air conditioning, kitchen appliances, electrical equipment or plumbing will not automatically render the property unfit or uninhabitable. No amenities are guaranteed. the malfunction of amenities including, but not limited to , TV's and internet service will not entitle Guest to a refund. Every effort will be made to ensure repairs are made and that all equipment is kept in working order. Please report any inoperative equipment to Agent by calling (208) 245-4935 promptly. No refunds shall be granted due to acts of nature, delay in check-in, early departure, surrounding construction or noise.
4. PETS: PETS ARE STRICTLY FORBIDDEN!!! Further, Guests bringing pets to THE ST. MARIES INN will be denied occupancy or immediately evicted WITHOUT REFUND. Guests found to be violating this clause will be charged a $250 fee.
5. MAXIMUM OCCUPANCY: Guest(s) should not permit the property to be occupied beyond maximum occupancy. Violation of this clause will result in eviction and forfeiture of all monies paid. No RV's or campers may be parked on the Property for the purpose of extra sleeping capacity nor any more vehicles than necessary to accommodate the Guest(s).
6. CLEANING/DAMAGES/EXTRAS: A $40 cleaning fee per stay is included in the initial charge for each stay. Any extraordinary cleaning necessary (removal of personal and abandoned items, unreasonable amounts of time or supplies necessary to restore unit to sanitary and bookable status, etc.) will incur additional cleaning fees which will be charged to the credit card on file. Guest will receive an email from St. Maries Property Management or St. Maries Inn outlining any additional cleaning charges processed. Credit card on file will be charged for any TV charges, streaming services, movies, or any other NON-INCLUDED items. All damages or missing items will be charged to the Guest using the credit card provided at booking. If, for ANY reason, ANY of these charges are not able to be processed using the card provided during booking by Guest, Guest agrees to reimburse Agent for these charges incurred within 72 hours. If not fully reimbursed in the time allowed, Guest agrees to be held responsible for attorneys fees and any other costs necessary to collect for such damages as allowed by law.
7. SMOKING: This is a NON-SMOKING PROPERTY. No smoking is allowed in or on the premises at any time. If Guest is found to have smoked on or in the property, or is caught smoking on or in the property, this shall constitute a breach of this agreement and Guest will be charged a fee of $400 (charged to the card on file at time of booking/reservation) and will also be required to vacate the property IMMEDIATELY.
8. GUEST DUTIES: The Guest shall: (a.) Keep that part of the property he or she occupies and uses as clean and safe as the conditions of the property permit and cause no unsafe or unsanitary conditions in the common areas and remainder of the property. (b.) Dispose of all rubbish, garbage and other waste in a clean and sage manner. (c.) Keep all plumbing fixtures in the property or used by the Guest as clean as their condition permits. (d.) Not deliberately or negligently destroy, deface, damage or remove any part of the property or render inoperable the smoke detectors/fire extinguishers provided by the Owner, or knowingly permit any person to do so. (e.) Comply with all obligations imposed upon Guest by current applicable building and housing codes. (f.) Be responsible for all damage, defacement or removal of any of the property inside the property that is in his or her exclusive control. (g.) Notify the Owner/Agent of the need for replacement or repair to a smoke detector. Guest agrees not to use the property for any activity or purpose that violates any criminal law or governmental regulation, which includes, but is not limited to, marijuana/CBD smoking. Guest(s) breach of any duty contained in this paragraph shall be considered material, and shall result in IMMEDIATE removal of Guest.
9. EXPEDITED EVICTIONS: Any Guest who lets this property for 30 days or less may be evicted and removed from the property in an expedited eviction proceeding if the guest does one of the following: (a.) Holds over possession after his or her stay period has expired, (b.) Has committed a material breach of the terms of this agreement that, according to the terms of the agreement, results in immediate removal of Guest, (c.) Has obtained possession of the property by fraud or misrepresentation, (d.) fails to pay applicable funds as required by this agreement.
10. COMPETENCY: All parties to this Agreement verify that they are of legal age and/or otherwise competent to enter into this agreement.
11. GOVERNING LAW: This agreement shall be governed, construed, and interpreted by, through and under the Laws of the State of Idaho.
12: ENTIRE AGREEMENT: This Agreement is the entire agreement among the parties with respect to the subject matter hereof, and no representations or covenants, whether oral or written, have been made regarding the subject matter hereof except as provided herein.
13. SEVERABILITY: Every provision of this Agreement is intended to be severable, and if any term or provision hereof shall be declared illegal, invalid, or in conflict with Idaho Law or the purposes of the Agreement for any reason whatsoever, or if the enforcement of any provision shall be waived, the validity of the remainder of this Agreement shall not be affected thereby.
14. INDEMNIFICATION AND HOLD HARMLESS; RIGHT OF ENTRY; ASSIGNMENT: Guest agrees to indemnify and hold Agent and the Owner harmless to the extent allowed by law from and against any liability for personal injury or property damage sustained by any person (including anyone associated with Guest). Guest agrees that the Owner or their respective representatives may enter the Property during reasonable hours to inspect the Property, to make such repairs, alterations, or improvements thereto as Owner may deem appropriate or necessary. Guest shall not assign this Agreement or sublet the Property in whole or part without written consent of Owner/Agent.
15. LEAD-BASED PAINT DISCLOSURE: Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. Before letting pre-1978 properties, lessors must disclose the presence of lead-based paint and/or lead-based paint hazards in the building. Lessee must also receive a federally approved pamphlet on lead poisoning prevention. (This pamphlet is located in every room on the property and available to Guest in main office at 834 Main Avenue, St. Maries, Idaho 83861 or can be provided by email at Guest request). If Guest is unable to locate this pamphlet inside their room, please call (208) 245-4935 promptly and a copy will be delivered at no extra costs to Guest. This property IS defined as "Target Housing" regarding lead-based paint or lead-based paint hazards. The term "lead-based paint hazards" is intended to identify lead-based paint and all residual lead-containing dusts and soils regardless of the source of the lead. Guest hereby acknowledges the following (a.) Guest has been provided an EPA approved lead-based paint hazard information pamphlet, "Protect Your Family From Lead In Your Home", (b.) If not immediately available, guest acknowledges that Owner/Agent has provided contact information and other means of obtaining said pamphlet, (c.) has read and understands FULLY the disclosure contained herein pertaining to the risks of lead-based paint and lead-based paint hazards, (d.) receipt of all records, test reports or other information, if any, related to the presence of lead-based paint hazards on said Property. Additionally, if any structure was built before 1978 and is a residential home, apartment, or child-occupied facility such as a school or daycare center, federal law requires contractors that disturb lead-based paint in that structure to provide the owner with a "Renovate Right" pamphlet. The contractor shall be certified and follow specific work practices to prevent lead contamination.

Payment Policy

PAYMENT METHODS: Payment can be made to Agent in US funds by cash, money order, cashier's check, company check, personal check, MasterCard or Visa (a.) Credit Card payments will be processed through a third party depository and require a 4.5% service charge; (b.) When payment is made by credit card the person named as person authorizing booking must also be the person whose name is on the credit card, or approval must be made in writing by Agent prior to check-in date; (c.) a $35 service fee will be charged for all returned checks and credit/debit cards. You will be charged a 50% service charge for the total amount occurred on a daily basis for any disputed credit/debit card charges. Guest authorizes St. Maries Property Management to charge the credit card that is provided by Guest for services, violations, damages, etc. If payment is made by Cash, Money Order, Cashier's Check, Company Check or Personal Check (a.) A paper copy of the terms and agreements must be filled out and filed within the office at 834 Main Ave, St Maries, Idaho, 24 hours PRIOR to check-in; (b.) Drivers License must be presented to Agent, in person, 24 hours PRIOR to check-in for verification and photocopy; (c.) A credit card matching the identity of the person booking must be presented 24 hours PRIOR to check-in to record and will be held for cases of damages, cleaning required beyond reasonable, missing items or any other violations of the Terms herein or as allowable by law in the state of Idaho.

Cancellation Policy

1. All reservations and bookings are FINAL. No refund will be given for a cancellation unless the entire cancellation period has been re-rented to another guest. All cancellation or transfer requests must be made in writing. If the room booked is re-rented for the full contract amount all money pre-paid will be refunded less a $150.00 cancellation fee charged by Agent. If a reservation/booking is cancelled and not re-rented for the cancelled period, all advance payments will be forfeited by the Guest. If Guest does not arrive during the stay period, the reservation will be considered to have been cancelled and not re-rented. A transfer from one date to another available date on this property will require a $50.00 transfer fee and request must be made in writing at least 72 hours prior to check-in date. All transfers are subject to Agent approval and subject to availability. If no other similar room is available for transfer, Guest may either keep original booking or forfeit all monies pre-paid unless the room is re-rented per terms above.
